I suppose it's OK if you always launch/land at a jetty with enough depth.... but otherwise you surely risk damage if your rudder can't swing upwards ... unless you want to lift the entire thing right off before getting into shallow water.

No it is not legal.
Mirror class rules " the word shall is mandatory"
3.4 the rudder blade shall be able to rotate around the pivot
